Terms and Conditions – Flamingo Albir S.L (Albir Garden Resort)
INTRODUCTION
The present document establishes the general terms and conditions that regulate the contractual relationship between
Flamingo Albir S.L (Albir Garden Resort) hereinafter “the Hotel” and the users (hereinafter, “the Client” or “the Clients”) who contract and enjoy the services offered by the establishment. Making a reservation and/or using the Hotel’s facilities implies the full and unconditional acceptance of these general conditions, which may be complemented by specific conditions that, if applicable, are established for specific services.
Flamingo Albir S.L (Albir Garden Resort) is known for offering an experience that combines nature with modern comfort, located near the city of Benidorm, providing its clients with an ideal environment to disconnect without depriving themselves of any comfort.
1. RESERVATIONS AND ADMISSION
1.1 Reservation Process
To formalize a reservation at
Flamingo Albir S.L (Albir Garden Resort), the Client must follow the procedure established on the official website (https://www.albirgardenresort.com/) or contact the Hotel directly through the contact information provided (phone: +34 96 6865901, email: booking@sun-confort.com). The reservation will be confirmed once the Client has received written confirmation from the Hotel and has made the payment of the corresponding deposit as established in the payment conditions.
1.2 Admission Requirements
To be admitted to the Hotel, it is mandatory to:
- Present a valid identification document for all guests over 14 years old (ID card, passport or equivalent document).
- Fill out and sign the registration form established by current regulations.
- Accept and comply with the Hotel’s internal rules.
- Make the payment according to the current rates at the time of the stay.
1.3 Right of Admission
The Hotel reserves the right of admission and may expel any person who violates the internal rules, disturbs the peace of other clients, shows inappropriate behavior, or causes damage to the facilities, without any right to reimbursement.
2. ECONOMIC CONDITIONS
2.1 Rates
The applicable rates will be those published on the Hotel’s official website or those provided directly by the staff of the establishment at the time of booking. Prices may vary depending on the season, type of accommodation or pitch, number of people, and additional services contracted. All prices include the VAT applicable at the time of billing. Any change in the tax rate will be reflected in the final price.
2.2 Deposit and Payment Method
To confirm a reservation, a deposit will be required, the amount of which will be determined based on the type of accommodation and length of stay, and will be communicated to the Client at the time of booking. The deposit payment can be made by credit/debit card through the secure payment platform on the website, bank transfer, or any other payment method accepted by the Hotel. The remaining amount must be paid upon arrival at the Hotel, before installation or access to the reserved accommodation.
2.3 Deposit
The Hotel may request a deposit as a guarantee to cover possible damages or defects in the facilities or equipment. This deposit will be fully refunded at the end of the stay, after verifying the condition of the accommodation and equipment.
3. CANCELLATION AND MODIFICATION POLICY
3.1 Cancellations by the Client
Cancellations must be communicated in writing through the Hotel’s official email (booking@sun-confort.com). The deposit refund conditions are as follows:
- Cancellation 72h or less before the client’s arrival and no show will be charged 2 nights.
- The Hotel may change minimum stays and/or prices when it deems it appropriate.
- Minimum stays: from Sunday to Thursday: 1 night, Friday and Saturday: 2 nights.
- Easter minimum 3 nights.
3.2 Reservation Modifications
Requests for reservation modifications (dates, type of accommodation, number of people, etc.) are subject to availability and must be communicated as far in advance as possible. The Hotel does not guarantee the possibility of making such modifications, especially during high season. Modifications that involve a reduction in the number of days or type of accommodation may be subject to the partial cancellation conditions established in point 3.1.
3.3 Cancellations by the Hotel
The Hotel reserves the right to cancel a reservation in case of force majeure, unforeseen circumstances, or for security reasons. In these cases, the Client will be offered the possibility to change the dates of their stay (subject to availability) or a full refund of the deposit paid, without any additional compensation.
4. STAY AND COEXISTENCE RULES
4.1 Hours
The reception, check-in, and check-out times will be as established by the Hotel and will be visible in the facilities and on the website. As a general rule:
- Check-in: from 17:00 onwards.
- Check-out: 10:00.
Failure to comply with these times without prior agreement with the Hotel management may result in additional charges.
4.2 Coexistence Rules and Use of Facilities
During their stay at the Hotel, Clients must respect the following basic rules of coexistence:
- Respect the rest of the campers, especially during quiet night hours (from 24:00 to 8:00).
- Use the Hotel’s facilities and equipment properly and responsibly.
- Supervise minors under their responsibility at all times.
- Respect the specific rules for the use of each facility (pools, gym, robotics club, Olympic pool, soccer fields, meeting rooms, common areas, etc.).
- Maintain cleanliness and order in all areas of the Hotel.
- Properly manage waste, using the selective collection containers available.
- Respect the flora and fauna of the environment.
4.3 Visits
Visits to Clients staying at the Hotel must be authorized in advance by management and registered at reception. They may be subject to a fee according to the current conditions. The staying Client will be responsible for the behavior of their visitors during their stay at the Hotel.
5. FACILITIES AND SERVICES
5.1 Description and Availability
The Hotel offers various facilities and services for the enjoyment of its Clients, including:
- Gym: equipped with modern machines to maintain physical activity during the stay.
- Pools: two impressive outdoor pools and an indoor pool, including a children’s pool for the little ones.
The availability and hours of these services may vary depending on the season and will be duly indicated in the Hotel’s facilities.
5.2 Conditions of Use
The use of the Hotel’s facilities and services is reserved exclusively for registered Clients and their authorized visitors. Each facility may have specific rules of use that must be respected at all times. The Hotel reserves the right to establish capacity limitations or usage restrictions for security, maintenance, or force majeure reasons.
5.3 Payment Services
Some services or activities may be subject to additional fees, which will be duly informed to the Client before contracting them.
6. RESPONSIBILITIES
6.1 Hotel’s Responsibility
The Hotel undertakes to keep the facilities in good working order and cleanliness, as well as to provide the services offered with the utmost diligence and professionalism. The Hotel is not responsible for:
- Theft, losses, or damages of any kind caused by third parties to the Clients’ belongings.
- Accidents or injuries resulting from the misuse of the facilities or non-compliance with established rules.
- Damages caused by weather phenomena, natural disasters, fires not attributable to the Hotel, or other force majeure circumstances.
6.2 Client’s Responsibility
The Client will be responsible for:
- Damages or defects caused by themselves or by the people under their care to the facilities, equipment, or property of the Hotel or other Clients.
- The custody of their personal and valuable belongings during the entire stay.
- The proper behavior of all members of their group or family unit, including minors.
- Compliance with all rules established in this document and in the Hotel’s internal regulations.
7. DATA PROTECTION AND PRIVACY POLICY
7.1 Data Collection and Processing
In accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016, on the protection of individuals with regard to the processing of personal data (RGPD) and Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights, the Hotel informs that:
- The personal data provided by the Client will be included in a file owned by the Hotel for the purpose of managing the reservation, stay, and providing the contracted services.
- The legal basis for the processing of this data is the execution of the accommodation contract and compliance with legal obligations.
- The data will be kept for the time necessary to fulfill the purpose for which it was collected and to determine the possible liabilities that may arise from that purpose.
- Data will not be transferred to third parties, except by legal obligation or with the express consent of the data subject.
7.2 Customer Rights
The Client can exercise their rights of access, rectification, deletion, limitation, portability, and opposition by contacting the Hotel’s address or the email booking@sun-confort.com in writing, attaching a copy of their ID.
7.3 CCTV
The Hotel may have video surveillance systems for security reasons. The captured images will be processed in accordance with current regulations and will be deleted within the legally established deadlines, unless they must be kept to prove acts against the integrity of people, property, or facilities.
8. INTELLECTUAL AND INDUSTRIAL PROPERTY
All content of the Hotel’s website, including texts, photographs, graphics, images, icons, technology, software, links, and other audiovisual or sound content, as well as its graphic design and source code, are the intellectual property of the Hotel or third parties, without the Client being granted any of the exploitation rights recognized by current intellectual and industrial property regulations.
9. APPLICABLE LAW AND JURISDICTION
These general conditions are governed by Spanish law. For the resolution of any dispute that may arise regarding the validity, interpretation, compliance, or resolution of these conditions, the Client and the Hotel expressly submit to the Courts and Tribunals of the place where the Hotel is located, waiving any other jurisdiction that may correspond to them.
10. MODIFICATION OF CONDITIONS
The Hotel reserves the right to modify these general conditions at any time. The modifications will not affect already confirmed reservations, unless such modifications are favorable to the Client.
